What “POSS CS PG 1/1-B <1G” means

Texas Health and Safety Code § 481.115(b) is the lowest tier of the Penalty Group 1 and Penalty Group 1-B possession statute, reaching knowing or intentional possession of less than one gram, aggregate weight including any adulterants or dilutants. Penalty Group 1 includes cocaine, heroin, methamphetamine, ketamine, and oxycodone; Penalty Group 1-B, created effective September 1, 2023, consists of fentanyl, alpha-methylfentanyl, and other fentanyl derivatives. The State must prove the person exercised actual care, custody, control, or management over the substance and knew of its presence and nature; possession may be sole or joint, but mere proximity by itself does not establish it. No intent to deliver is required — that additional element would move the charge to § 481.112 or § 481.1123. This under-one-gram variant is a state jail felony, distinguished from the higher tiers solely by weight.
