What “POSS CS PG 1/1-B >=1G<4G” means

Texas Health and Safety Code § 481.115(c) covers knowingly or intentionally possessing a controlled substance listed in Penalty Group 1 or Penalty Group 1-B — unless obtained directly from or under a valid prescription or order of a practitioner — in an aggregate weight, including adulterants or dilutants, of one gram or more but less than four grams. Penalty Group 1 includes cocaine, heroin, methamphetamine, ketamine, and oxycodone; Penalty Group 1-B, created in 2023, consists of fentanyl, alpha-methylfentanyl, and other fentanyl derivatives. Possession means actual care, custody, control, or management of the substance, and the State must prove the person knew of it and exercised control over it. Unlike § 481.112, no intent to deliver is required. The one-to-four-gram bracket makes this a third-degree felony, between subsection (b), for under one gram, and subsection (d), which begins at four grams.
