What “POSS CS PG 1/1-B >=200G<400G” means

Texas Health and Safety Code § 481.115(e) applies when a person knowingly or intentionally possesses a controlled substance in Penalty Group 1 or Penalty Group 1-B, other than by valid prescription, and the aggregate weight, including adulterants or dilutants, is 200 grams or more but less than 400 grams. Penalty Group 1 covers drugs such as cocaine, heroin, and methamphetamine; Penalty Group 1-B contains fentanyl and its derivatives, separated into their own group effective September 1, 2023. Possession is a knowing exercise of actual care, custody, control, or management over the substance; no sale, delivery, or intent to deliver is required, which distinguishes this statute from the manufacture-or-delivery offenses in §§ 481.112 and 481.1123. The 200-to-400-gram range makes this bracket a first-degree felony, above subsection (d)'s four-to-200-gram tier and below subsection (f)'s 400-gram threshold.
