Texas Health and Safety Code § 481.115(d) covers knowing or intentional possession of a controlled substance in Penalty Group 1 or Penalty Group 1-B, not obtained under a valid prescription, in an aggregate weight, including adulterants or dilutants, of four grams or more but less than 200 grams. Penalty Group 1 lists drugs such as cocaine, heroin, methamphetamine, and oxycodone; Penalty Group 1-B holds fentanyl and its derivatives, which the Legislature moved out of Penalty Group 1 in 2023. The State must prove the person exercised actual care, custody, control, or management over the substance with knowledge of it; intent to deliver is not an element. Because adulterants and dilutants count, the weight element refers to the entire mixture. The four-to-200-gram range makes this a second-degree felony, sitting between subsection (c)'s one-to-four-gram tier and subsection (e)'s 200-gram floor.
