Texas Health and Safety Code § 481.113(b) is the lowest weight bracket for manufacture or delivery of a Penalty Group 2 or Penalty Group 2-A controlled substance: the aggregate weight, including any adulterants or dilutants, must be less than one gram. The State must prove the person knowingly manufactured, delivered, or possessed with intent to deliver the drug. Penalty Group 2 includes hallucinogens such as MDMA (ecstasy), psilocybin, and mescaline, together with tetrahydrocannabinol in forms other than the marihuana plant; Penalty Group 2-A consists of synthetic cannabinoids sold under names like "K2" and "Spice." "Deliver" covers any actual or constructive transfer and includes offering to sell, while possession with intent to deliver requires care, custody, control, or management of the substance plus intent to transfer it. This under-one-gram variant is a state jail felony, separated from the higher brackets solely by quantity.
