Texas Health and Safety Code § 481.113(e) is the top weight bracket for manufacture or delivery of a Penalty Group 2 or Penalty Group 2-A controlled substance. The State must prove that the person knowingly manufactured, delivered, or possessed with intent to deliver the substance and that the aggregate weight, including any adulterants or dilutants, was 400 grams or more.
