What “MAN/DEL CS PG 2 OR 2-A >= 4G <400G” means

Texas Health and Safety Code § 481.113(d) applies when a person knowingly manufactures, delivers, or possesses with intent to deliver a controlled substance in Penalty Group 2 or Penalty Group 2-A and the aggregate weight, including adulterants or dilutants, is four grams or more but less than 400 grams. Penalty Group 2 consists mostly of hallucinogenic drugs — MDMA, psilocybin, mescaline — and tetrahydrocannabinol other than plant-form marihuana, such as THC concentrates and vape oils; Penalty Group 2-A covers synthetic cannabinoids. Delivery is defined broadly as any actual or constructive transfer to another person, including an offer to sell, and manufacture includes compounding, converting, processing, and packaging. Unlike the Penalty Group 1 statute, this statute has no separate 200-gram tier: the single four-to-400-gram bracket, a first-degree felony, runs from subsection (c)'s ceiling to subsection (e)'s 400-gram floor.
