What “MAN/DEL CS PG 1 >= 4G < 200G” means

Texas Health and Safety Code § 481.112(d) applies when a person knowingly manufactures, delivers, or possesses with intent to deliver a controlled substance in Penalty Group 1 and the aggregate weight, including adulterants or dilutants, is four grams or more but less than 200 grams. Penalty Group 1 includes cocaine, heroin, methamphetamine, ketamine, and most opioids; fentanyl and its derivatives were reassigned to Penalty Group 1-B effective September 1, 2023. The mental state is knowledge, and "delivery" is defined broadly to include any actual or constructive transfer to another person as well as an offer to sell. Because adulterants and dilutants count toward the total, the weight element refers to the whole mixture rather than the pure drug. The four-to-200-gram bracket makes this a first-degree felony, distinguishing it from subsection (c), which covers one to four grams.
