Texas Health and Safety Code § 481.112(c) is a mid-level weight bracket of the State's principal drug-dealing statute for Penalty Group 1, which includes cocaine, heroin, methamphetamine, ketamine, and most opioids other than fentanyl (fentanyl now sits in Penalty Group 1-B). The State must prove the person knowingly manufactured, delivered, or possessed with intent to deliver the substance, and that its aggregate weight, including any adulterants or dilutants, was one gram or more but less than four grams. "Deliver" means to transfer the substance to another actually or constructively, and includes an offer to sell; possession with intent to deliver requires actual care, custody, control, or management of the drug coupled with an intent to transfer it. This second-degree felony bracket sits between subsection (b), for under one gram, and subsection (d), which starts at four grams.
