Texas Health and Safety Code § 481.1123(b) covers knowingly manufacturing, delivering, or possessing with intent to deliver a controlled substance in Penalty Group 1-B in an aggregate weight, including adulterants or dilutants, of less than one gram. Penalty Group 1-B was created effective September 1, 2023, and consists of fentanyl, alpha-methylfentanyl, and other derivatives of fentanyl, which the Legislature removed from Penalty Group 1 and placed in a separate offense statute. The required mental state is knowledge; "deliver" means an actual or constructive transfer to another, including an offer to sell, and "manufacture" includes producing, compounding, converting, processing, or packaging the substance. Even at less than one gram the offense is classified as a third-degree felony, one degree higher than the state jail felony that applies to the same quantity of a Penalty Group 1 substance under § 481.112(b).
