Texas Health and Safety Code § 481.1123(f) requires the State to prove that a person knowingly manufactured, delivered, or possessed with intent to deliver a controlled substance listed in Penalty Group 1-B, and that the aggregate weight of the substance, including any adulterants or dilutants, was 400 grams or more. Penalty Group 1-B, created effective September 1, 2023, consists of fentanyl, alpha-methylfentanyl, and other derivatives of fentanyl, which the Legislature separated out of Penalty Group 1. "Deliver" means to transfer a controlled substance to another person, actually or constructively, and includes offering to sell it; "manufacture" covers producing, preparing, compounding, converting, processing, or packaging the substance. The 400-gram floor is the statute's highest weight bracket, distinguishing this first-degree felony variant from subsections (b) through (e), which govern smaller quantities.
