Texas Health and Safety Code § 481.1123 defines manufacture or delivery of a controlled substance in Penalty Group 1-B, the penalty group covering fentanyl, alpha-methylfentanyl, and other derivatives of fentanyl listed in Texas Health and Safety Code § 481.1022, created by the Legislature effective September 1, 2023. The State must prove that the person knowingly manufactured, delivered, or possessed with intent to deliver a Penalty Group 1-B substance without authorization under the Texas Controlled Substances Act; delivery includes actual transfer, constructive transfer, and an offer to sell. Weight is measured by aggregate weight, including any adulterants and dilutants, meaning the entire mixture containing the fentanyl counts toward the bracket. This variant, subsection (e), applies to the second-highest weight bracket in the statute: 200 grams or more but less than 400 grams.
