Texas Penal Code § 31.03 defines theft as unlawfully appropriating property with intent to deprive the owner of it. Section 31.03(e)(4)(A) makes theft a state jail felony not only for property valued between $2,500 and $30,000 but also, as charged here, when the property is fewer than 10 head of sheep, swine, or goats — or any part thereof — with a value under $30,000. For this livestock variant, the animal category substitutes for the usual dollar floor: the State must prove the unlawful appropriation, the intent to deprive, the species and number of animals, and a value under $30,000. Larger or different livestock thefts are graded more severely by § 31.03(e)(5), which makes it a third-degree felony to steal cattle, horses, or exotic livestock, or 10 or more head of sheep, swine, or goats, in a single transaction with an aggregate value under $150,000.
