What “TERRORISTIC THREAT OF FAMILY/HOUSEHOLD” means
Texas Penal Code § 22.07 defines terroristic threat. For this variant the State must prove the defendant threatened to commit any offense involving violence to any person or property with intent to place any person in fear of imminent serious bodily injury, and, under § 22.07(c)(1), that the threat was committed against a member of the defendant's family or household or against a person with whom the defendant has or has had a dating relationship, as those terms are defined by Chapter 71 of the Texas Family Code. The family, household, or dating relationship raises the offense from a Class B to a Class A misdemeanor and distinguishes this charge from the base offense. As with other terroristic threat variants, the offense is complete when the threat is made with the required intent; the State need not prove the defendant intended to carry it out or that the victim was actually placed in fear.
