Texas Penal Code § 22.07 defines terroristic threat. For this variant the State must prove the defendant threatened to commit any offense involving violence to any person or property with intent to place any person in fear of imminent serious bodily injury, and that the threat was committed against a public servant. Texas Penal Code § 1.07 defines a public servant to include a person elected, selected, appointed, employed, or otherwise designated as an officer, employee, or agent of government, as well as jurors, notaries, and candidates for public office, among others. Under § 22.07(c)(2), the public-servant allegation raises the offense from a Class B to a Class A misdemeanor. The offense turns on the threat and the accompanying intent to cause fear of imminent serious bodily injury; proof that the target was actually frightened, or that the defendant meant to follow through, is not required.
