Texas Health and Safety Code § 481.1161(b)(2) covers knowing or intentional possession of a controlled substance in Penalty Group 2-A in an amount, by aggregate weight including adulterants or dilutants, of more than two ounces but no more than four ounces. Penalty Group 2-A consists of synthetic chemical compounds that mimic cannabinoids — synthetic cannabinoids commonly sold as "K2" or "Spice" — as distinct from marihuana itself, which is covered by a separate statute, and from other Penalty Group 2 substances, whose possession is measured in grams under § 481.116. Possession means actual care, custody, control, or management of the substance, exercised knowingly. The two-to-four-ounce window is the element that makes this variant a Class A misdemeanor rather than the Class B misdemeanor that applies at two ounces or less under subsection (b)(1).
