Criminal mischief under Texas Penal Code § 28.03 is committed when, without the effective consent of the owner, a person intentionally or knowingly damages or destroys the owner's tangible property, tampers with the owner's tangible property and causes pecuniary loss or substantial inconvenience to the owner or a third person, or makes markings — including inscriptions, slogans, drawings, or paintings — on the owner's property.
