What “BURGLARY OF BUILDING” means

Texas Penal Code § 30.02(c)(1) denotes burglary of a building other than a habitation, a state jail felony. The State must prove that, without the effective consent of the owner, the defendant either entered a building — or a portion of a building — not then open to the public with intent to commit a felony, theft, or assault; remained concealed in the building with that intent; or entered the building and committed or attempted to commit a felony, theft, or assault. "Enter," under § 30.02(b), means to intrude any part of the body or any physical object connected with the body. The nature of the premises is the dividing line among burglary grades: this variant applies to commercial and other non-residential buildings, while burglary of a habitation — a structure adapted for overnight accommodation of persons — is graded more severely under § 30.02(c)(2) and § 30.02(d).
