What “BURGLARY HABITATION INTEND OTHER FELONY” means
Texas Penal Code § 30.02(d) defines the first-degree variant of burglary of a habitation involving a felony other than felony theft. The State must prove a burglary under § 30.02(a): that, without the effective consent of the owner, the defendant entered a habitation with intent to commit a felony, theft, or assault; remained concealed there with such intent; or entered and committed or attempted to commit a felony, theft, or assault.
