Texas Penal Code § 22.01(c)(1) denotes offensive-contact assault committed against an elderly or disabled individual. The underlying offense is defined by § 22.01(a)(3): intentionally or knowingly causing physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative. Ordinarily that conduct is a Class C misdemeanor, but subsection (c)(1) raises it to a Class A misdemeanor when the contact is committed against an elderly individual or a disabled individual, as those terms are defined by Texas Penal Code § 22.04 — an elderly individual being a person 65 years of age or older, and a disabled individual being a person with a qualifying disability or condition who is substantially unable to protect himself or herself from harm or to provide for his or her own care. No bodily injury is required for this variant.
