Assault Causes Bodily Injury in Texas: what bail is set at, how often a personal bond is granted, and what usually happens to the charge.
What “ASSAULT CAUSES BODILY INJ” means
Texas Penal Code § 22.01(a)(1) defines the basic bodily-injury form of assault. The State must prove that the defendant intentionally, knowingly, or recklessly caused bodily injury to another person, including the defendant's spouse. "Bodily injury" is defined broadly by Texas Penal Code § 1.07 as physical pain, illness, or any impairment of physical condition; no visible wound, medical treatment, or lasting harm is required, and physical pain alone can satisfy the element. Recklessness — consciously disregarding a substantial and unjustifiable risk — is the least demanding of the three culpable mental states that will suffice. This variant is distinguished from assault by threat under § 22.01(a)(2) and offensive-contact assault under § 22.01(a)(3), neither of which involves injury, and from aggravated assault under § 22.02, which requires serious bodily injury or a deadly weapon. Without the enhancing circumstances listed elsewhere in § 22.01, the offense is a Class A misdemeanor.
| Charged as | Share of bail records | Possible confinement | Fine | Source |
|---|---|---|---|---|
| Class A misdemeanor | 100% | Up to 1 year in county jail | Fine up to $4,000 | Penal Code § 12.21 |
Ranges are the statutory maximums for the level; enhancements, prior convictions and plea agreements change what is actually imposed.
