VIOL PROTECT ORDER BIAS/PREJUDICE

Texas Penal Code § 25.071 addresses violation of a protective order issued to prevent offenses motivated by bias or prejudice — the hate-crime protective orders authorized by Subchapter C, Chapter 7B of the Texas Code of Criminal Procedure. A person subject to such an order commits an offense by knowingly or intentionally: committing an offense against the person under Penal Code Title 5, or arson, criminal mischief, or graffiti, because of bias or prejudice as described by Code of Criminal Procedure Article 42.014; communicating with a protected individual in a threatening or harassing manner, conveying a threat, or communicating at all when the order prohibits communication; or going to or near the protected individual's residence, place of employment, or business. The offense is a Class A misdemeanor, becoming a third-degree felony on two prior convictions or where the violation was an assault.
