Texas Transportation Code § 545.401 defines reckless driving. A person commits the offense by driving a vehicle in wilful or wanton disregard for the safety of persons or property. The mental state is the heart of the charge: wilful or wanton disregard means a deliberate, conscious indifference to the safety of others, something more than a momentary lapse of attention or ordinary negligence. No collision, injury, or property damage is required — the State must prove only the manner of driving and the driver's conscious indifference.
