RECKLESS DRIVING

Texas Transportation Code § 545.401 defines reckless driving. A person commits the offense by driving a vehicle in wilful or wanton disregard for the safety of persons or property. The mental state is the heart of the charge: wilful or wanton disregard means a deliberate, conscious indifference to the safety of others, something more than a momentary lapse of attention or ordinary negligence. No collision, injury, or property damage is required — the State must prove only the manner of driving and the driver's conscious indifference. Unlike most rules of the road, the statute expressly applies not only on highways and other public places but also on certain private areas, such as access ways and parking lots that businesses provide for clients and patrons.
