PURCHASE FURNISH ALCOHOL TO A MINOR

Texas Alcoholic Beverage Code § 106.06 makes it an offense to purchase an alcoholic beverage for a minor, to give an alcoholic beverage to a minor, or, with criminal negligence, to make an alcoholic beverage available to a minor. A minor for alcohol purposes is a person under 21 years of age. As the statute is written, criminal negligence attaches to the making-available theory, while the purchasing and giving theories are stated without a separate express mental state. The statute contains a family exception: an adult parent, guardian, or spouse of the minor — or an adult in whose custody a court has committed the minor — may furnish alcohol when that adult is visibly present while the minor possesses or consumes it. Subsection (c), cited in the court record, is the provision classifying the offense; the conduct elements appear in subsection (a).
