What “PROH WEAPON” means
Texas Penal Code § 46.05 prohibits weapons the Legislature has designated as having no common lawful purpose. A person commits the offense by intentionally or knowingly possessing, manufacturing, transporting, repairing, or selling a listed item: an explosive weapon, machine gun, or short-barrel firearm (unless the item is registered under the National Firearms Act or otherwise exempt, such as a curio or relic); armor-piercing ammunition; a chemical dispensing device; a zip gun; a tire deflation device; or an improvised explosive device. Firearm silencers were removed from the list in 2021. The weapon terms are defined in Texas Penal Code § 46.01, and the statute contains defenses for conduct incidental to lawful duties, such as law enforcement functions. Subsection (e), cited in the court record, is the provision classifying offenses under the section; the conduct and knowledge elements come from subsection (a).
