Texas Health and Safety Code § 481.114(c) covers knowingly manufacturing, delivering, or possessing with intent to deliver a controlled substance listed in Penalty Group 3 or Penalty Group 4, in an aggregate weight, including adulterants or dilutants, of 28 grams or more but less than 200 grams. Penalty Group 3 consists mainly of prescription medications with stimulant or depressant effects, such as alprazolam (Xanax), diazepam (Valium), and anabolic steroids; Penalty Group 4 covers compounds containing limited quantities of narcotic drugs mixed with nonnarcotic medicinal ingredients, such as some codeine cough preparations. Delivery means an actual or constructive transfer to another person and includes an offer to sell. The 28-to-200-gram bracket makes this a second-degree felony and distinguishes it from subsection (b), which applies below 28 grams, and subsection (d), which begins at 200 grams.
