INTOXICATION ASSAULT W/VEHICLE SBI

Texas Penal Code § 49.07 defines intoxication assault. In the motor-vehicle variant this charge reflects, a person commits the offense by operating a motor vehicle in a public place while intoxicated and, by reason of that intoxication, causing serious bodily injury to another by accident or mistake. "Intoxicated" carries its Chapter 49 meaning: not having the normal use of mental or physical faculties because of alcohol, a controlled substance, a drug, a dangerous drug, or a combination, or having an alcohol concentration of 0.08 or more. "Serious bodily injury" means injury that creates a substantial risk of death or that causes serious permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ. The State must prove causation — that the intoxication, not merely the collision, brought about the injury. Subsection (c) classifies the offense as a third-degree felony.
