What “HINDER APPREHENSION OR PROSECUTION KNOWN FELON” means

Texas Penal Code § 38.05 defines hindering apprehension or prosecution. A person commits the offense if, with intent to hinder the arrest, prosecution, conviction, or punishment of another for an offense — or the arrest, detention, adjudication, or disposition of a child for felony-grade delinquent conduct — the person harbors or conceals the other, provides or aids in providing any means of avoiding arrest or effecting escape, or warns the other of impending discovery or apprehension. Under subsection (d), the offense becomes a third-degree felony when the person assisted is under arrest for, charged with, or convicted of a felony and the actor knows that fact — the "known felon" element reflected in the charge label. Without proof of that knowledge of felony status, the offense remains the Class A misdemeanor version of the statute.
