The State must prove that the person, with intent to harm or defraud another, obtained, possessed, transferred, or used an item of another person's identifying information without consent, identifying information of a deceased person, or identifying information of a child younger than 18. Under subsection (c)(2), the offense is a third-degree felony when the number of items obtained, possessed, transferred, or used is five or more but fewer than ten.
