Texas Penal Code § 37.08 defines false report to a peace officer, federal special investigator, law enforcement employee, corrections officer, or jailer — the offense abbreviated on court records as "FALSE STMNT TO PO/SP INV/LAW ENF EMPL/CORR OFF." The State must prove the accused, with intent to deceive, knowingly made a false statement that was material to a criminal investigation, and made it to a peace officer or federal special investigator conducting the investigation, to an employee of a law enforcement agency authorized to conduct the investigation whom the accused knew was conducting it, or to a corrections officer or jailer. Materiality and the intent to deceive are required elements, so an honest but mistaken statement is not covered. The offense is graded as a Class B misdemeanor under § 37.08(c).
