Texas Health and Safety Code § 481.133 defines the offense of falsification of drug test results. Under § 481.133(a), the State must prove the accused knowingly or intentionally used, or possessed with intent to use, a substance or device designed to falsify drug test results, such as synthetic urine or a concealed substitution device. A "drug test" for this purpose is a lawfully administered test designed to detect the presence of a controlled substance or marihuana. The use-or-possession conduct in subsection (a) is graded as a Class B misdemeanor and is distinct from § 481.133(b), which separately criminalizes knowingly or intentionally delivering, possessing with intent to deliver, or manufacturing with intent to deliver such a substance or device. The required mental state is knowing or intentional conduct with respect to the falsifying substance or device.
