Delivery of marihuana is prohibited by Texas Health and Safety Code § 481.120, which makes it an offense to knowingly or intentionally deliver marihuana. 'Deliver' means to transfer marihuana to another person, actually or constructively, and includes offering to sell it. The statute grades the offense by the amount delivered and, at the smallest weights, by whether the actor was compensated. This variant, § 481.120(b)(2), applies when the amount delivered is one-fourth ounce or less and the actor receives remuneration — payment or other compensation — for the delivery. Remuneration is the element that separates this Class A misdemeanor form from § 481.120(b)(1), the Class B form covering delivery of the same small amount without payment. 'Marihuana' is defined by § 481.002 to mean the cannabis plant and preparations of it, subject to exclusions that include legal hemp and certain parts of the plant.
