Texas Penal Code § 32.42 makes it an offense to commit certain deceptive business practices in the course of business, including using or possessing for use a false weight or measure or another device for falsely determining quality or quantity, selling less than the represented quantity of a property or service, selling an adulterated or mislabeled commodity, and passing off property or services as those of another. This charge is graded under § 32.42(c)(2), reflected in the court-record label 'with previous conviction/intentional/knowing/reckless': the State must prove the actor committed the deceptive practice intentionally, knowingly, or recklessly, or committed it with criminal negligence after having previously been convicted under the statute. That mental-state or prior-conviction showing is what makes the offense a Class A misdemeanor and distinguishes it from the Class C grade for a first offense committed only with criminal negligence.
