CRIMINAL TRESPASS

Criminal trespass, Texas Penal Code § 30.05, requires proof that a person entered or remained on or in property of another — including residential land, agricultural land, a recreational vehicle park, a building, an aircraft, or another vehicle — without effective consent, and that the person either had notice that the entry was forbidden or received notice to depart but failed to do so. 'Notice' is defined broadly: it includes oral or written communication by the owner or someone with apparent authority to act for the owner, fencing or other enclosures obviously designed to exclude intruders or contain livestock, posted signs, purple paint marks on trees or posts meeting statutory specifications, and the visible presence of crops grown for human consumption. This entry describes the baseline offense graded by § 30.05(d)(1) as a Class B misdemeanor, without the aggravating circumstances — a deadly weapon or protected locations — that elevate other variants.
