Capital murder under Texas Penal Code § 19.03(a)(2) requires proof that a person intentionally committed murder — intentionally or knowingly causing the death of an individual as described by § 19.02(b)(1) — in the course of committing or attempting to commit one of a list of specified felonies: kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or certain forms of terroristic threat under § 22.07. The killing itself must be intentional, and it must occur during the commission or attempted commission of, or in immediate flight from, the underlying felony. The court-record label 'by terror threat/other felony' indicates the alleged underlying felony is terroristic threat or another offense on that list, distinguishing this theory from the other capital-murder theories in § 19.03, such as murder of a peace officer, murder for remuneration, or murder of a young child.
